After an accident there are a number of things to remember:
1. Document the facts of what happened. Take pictures of the scene of the accident, damage to any vehicles, and injuries to the victims. Get the names and contact information for witnesses. Obtain insurance information from the other parties. Save any damaged material that may be evidence of the accident, such as a broken bike helmet, damaged bicycle, torn or damaged clothing, broken personal effects, etc...
2. Immediately seek medical attention. If you are seriously injured go to the nearest emergency room for examination and treatment. Contact your personal physician and notify them about your injuries. Make sure to follow up with all necessary medical appointments. If your injuries and condition are not improving consider obtaining a second opinion from a different healthcare provider to make sure that the original diagnosis and treatment plan are appropriate.
3. Do not speak to the insurance company of the other parties about the facts of the accident or your injuries. You should only do this if you have retained an attorney and that attorney advises you to do so with the attorney present.
4. Document your damages, including lost wages, medical bills, consequential damages including costs of medications, necessary expenses caused by the accident, pain and suffering and emotional distress. If you are suffering from severe emotional distress you should seek counseling from a mental health professional.
5.Hire a qualified and licensed attorney to represent you in your legal matter as soon as possible. There are strict time deadlines for pursuing claims, and failure to meet those deadlines can result in permanent loss of your legal rights.
This list is not meant to include everything you should do after an accident! Every accident is different, and it is best to consult with an attorney promptly.
